Is CBD Legal? In which states, and in what forms?

ABOUT THE PLANT 

CBD (short for cannabidiol) and THC (short for tetrahydrocannabinol) are chemical compounds found in the cannabis sativa plant – a species that includes both cannabis and hemp plants. Hemp plants contain higher amounts of CBD and cannabis plants contain higher amounts of THC (the intoxicatingly psychoactive compound). 

This is where it may get confusing. When CBD is derived from hemp, the psychoactive component is almost non-existent. CBD from hemp reacts with the body’s receptors without having an intoxicating effect.  

CBD can also be derived from cannabis – and while the CBD molecule is the same regardless of its plant source, from a legal perspective, this type of CBD is treated differently. 

FARM BILL  

In 2018, the Farm Bill removed hemp from the Controlled Substances Act. At the federal level, CBD derived from a hemp source containing less than 0.3% THC by dry weight is legal because hemp is not a controlled substance. However, if CBD is derived from cannabis, it is considered a Schedule 1 substance and is illegal.

Hemp-derived CBD products (with less than 0.3% THC) are legal on the federal level but are still illegal under some state laws.
